I will repeat......your are quoting her side of the story only. What SHE has told the news outlets. Yes it had been investigated years ago and the police did see the videos because they charged one of the kids with a misdemeanor for distributing it. They did not find anything that warranted rape and or sexual abuse charges AT THAT TIME. Now.......years later the family is talking about pursing charges that they didn't pursue......nor did the police purse. Sometimes you have to be careful judging the potential victims account through the news that hasn't even interviewed the other side, nor takeen into account some reasonable discrepancies in the story.

But it doesn't matter. You have already judged.....I'm holding out for a more informed opinion. At some point we might have the same views but certainly not at this time. No use pushing a bad situation with anymore arguments on it.

Lots of reasons for there being no charges, one of which the victim was unwilling to participate in the prosecution. Does this mean it didn't happen? No it does not. This happens more times than people know and unless it happens to someone close to you, you may not understand. NE recently passed a law that rape kits can be collected by the hospitals and they are to be kept and booked into evidence as an anonymous victim. The victim can come back later to press ahead with sexual assault charges.

As Chris mentioned earlier, the most serious charges he faces are the distribution of Child Porn. These could be transferred to federal jurisdiction for various reasons.

As you have mentioned Sandbar, I agree, let's wait to see how this plays out, then we can argue whether he should be here or not.

So, before vids, and the guys talked, was it a felony?
And, hearing that talk, a possible jilted lover repeats what hes heard, all the details to his former lover, is that a felony because this happened when they were all 15?
The reason I put it this way is because, Mo hasnt shown the vid to anyone else as to what we know.
Now, hearing isnt seeing, a vid isnt like a story told, but that goes both ways.

The words people say are no different than anything else, but in recordings, its just vaified.
But then again, not all recordings are admissible in court.
Funny that distinction.

OK, its all relevant.
They were all juveniles at the time, he was too when he got the vid.
Holding onto it, there is a reason.
She getting kicked out of school, there is a reason.
A school doubling down in the wrong direction is very very liable in Cali, its like handing her money, itd be just the matter of her and her lawyer to determine how much was acceptable in Cali at the time, or even now, and Im sure itd be a high number.
This right here brings more questions.
If there was a reason for a fifteen year old jilted lover to hold onto a vid like this, we just need to understand what Mo was feeling, and whether its understandable and relevant.
The judge has had this in front of him for quite awhile, now the law is pushing, but again, how hard?
Will the law enforcement end of this be told to lay low by the justice end?
Theres too many things not known to consider no one has info on, her guilt, his guilt, where it sits, was it a felony,is it prosecutable?
The big problem is that, in spite of them all being juvies; the kiddie porn thing is a felony charge and will follow him around the rest of his life. I'm still hoping that a "friend" was dicking around with his phone but how does one prove that? My assumption would be that the DA interviewed people to see if they were with Mo on the date in question and that type of thing, trying to insure that he was the one who resent that video. So making the assumption that Mo did send that video, he is charged with the kiddie porn thing, will have a sex offender status for the rest of his life, etc. Yeesh.

All three were kicked out of school. If she was a willing participant, as should be. If she was raped then that is a huge lawsuit waiting to happen,

I posted this earlier and think it bears reasking the question -- would this be happening if Mo was not an upcoming star at UNL? As in making a statement because of his high visibility? Would this be happening if he was John Doe who works for Goodyear Tire or would it happen and we just wouldn't hear about it unless we were relatives?

My bottom line is that I wish Taylor had gone to the hospital after the incident. The rape kit and exam would pretty much answer the consensual question. As it stands now, there are always going to questions because it is her word against two young men. I have a hard time seeing a 15 year old wanting to "pull a train" but I'm in my 60's and it was a different time when I was 15.

Why would a rape kit change anything if its on video? That would only prove that there was sex as opposed to a video that would determine whether it is consensual.

Its just sad that this is something that Mo drug himself into. By all means, he needs to be punished for such a lack of judgment but it sure seems like it would have just been something everyone learned and moved on from if it hadnt been brought back up.

When a woman is violently raped or has sex against her will, there are physical changes to her personals. Often times, excessive bleeding, bruising, etc. This doesn't happen with consensual sex unless you like it "rough". That is used in court to prove that the sexual act was rape or non-consensual.

I think distinctions must be made.
Like, pot bad, reefer madness etc, cant be used as a medicine because we insist on carrying on taboos etc.
Defining law is part of refining law.
If the DA had any cajonnes, hed gave already gone after each time it was passed around the school, student by student, so, he/she is a phony DA participating in a bad system .
Thered have to be twenty prior arrests and verdicts made at the least by now.
All charged and marked for the rest of their lives, like so many other high school kids and younger, thousands and thousands of them.
If the law doesnt fit everyone, then who does it fit?

I absolutely agree. As it stands right now, only one of the two young men was charged with distributing kiddie porn. The technology exists to trace each time that video was shared. What phone shared it. The DA could and should go from there and charge everyone: be they male, female, underage, teacher, councilor, principal, coach, nurse, parent, whomever. Otherwise it is half-hearted justice and not equal justice for all.

Can you tell I'm really p*ssed at the situation? If the allegations are true Washington made a horrible mistake that is going to cost him dearly. I don't care if the act was consensual, that gave no one the right to post the video on the internet. I don't like the shaming of the young woman I am seeing in comments on the articles I've read and elsewhere on the internet. A classic example of why women are reluctant to report rapes. I worked for Lincoln PD when I went to UNL and typed up a supposition for a rape victim. The detective read my non-verbals and came to see me after he had escorted the victim out of the building. He explained to me that even though her screen had been cut and she had marks on her wrists and ankles from being bound, it was his job to show her what the defense attorney would put her through on the stand. I'm sure you can imagine -- how do you dress, how do you talk, how do you walk, do you frequent bars, one night stands, how many boyfriends, on and on and on. That was 1980 and not much has changed. The women still are put on trial rather than their assailant. And before anyone says anything, I am aware that women are known to scream rape when they've had a fight or are p*ssed at someone, etc. I do not condone that either. Makes it harder for the honest victims to get the justice they deserve. Some days I'm more acutely aware of what a sh*tty world we live in.

To me, current law is a facade to 'cover' a much much larger problem, which extends to all groups of all ages.
The box has long been open, and is why I refer to words and their place in history concerning legal address.
The condemnation of todays vids is but yesterdays stories, but those were rarely condemned.
To think we can put the genie back in the bottle is to deny history.
My point is, this whole thing has to be seen with a more traditional pov, not boys being boys, but boys admitting to crimes.
And though Mo admitted to crime by retelling the story, as that in itself is defined by our current laws as unlawful, does it speak to the true crime itself?
Theres a current hollywood 'star' that had many an X rated film, some at the age of fifteen.
Who there was prosecuted?
Was she? The filmakers? The distributors? All the rental joints?
The people renting them?
The precedent there means what today?
Now, everyone can be a filmaker, you can even be tricked into downloading such things, others having access to you electronics could get you in trouble etc etc.
The pandoras box is open, has been open, its time to granulate our laws appropriately

I start by saying I'm no lawyer and I don't want to get into an argument on this and I hesitate to even post, but I'm young and dumb so here we go...

This "case" will be playing out over months. Probably will never go to trial. Don't know that for sure but I bet many of these cases don't ever get to trial. Lets wait and see what the University knew. Sounds from initial reports not a lot. Will it make the news, probably... Will we see repercussions from it, well who knows...

Here's the deal. We have laws in this country. Many are made with good intentions but usually they come with unintended consequences. Whether we like it or not, Mo may have got himself in deep crap on this one. If he sent a video of a 15 year old having a wild night or being raped is not going to be the question in many of these cases. He had the damn thing and sent it... Bad Bad Bad. We can have arguments later whether this is right (the law), we can argue he said, she said too. That maybe immaterial.

Then you have the revenge porn. Now I read somewhere that in California, intending to cause emotional distress or something like that is how the law is worded. I have not heard what Mo texted for certain but from what I have seen, it seemed vindictive. If it is true, well seems like emotional abuse to me. Some here have questioned if he sent it. I do agree that something like a friend sending it to her seems unlikely but I guess this will play out too.

I thought I saw that there had been charges originally for someone that filmed this and sent it originally. Now if that is the case, Mo might just find himself the proverbial scapegoat if you will. Kinda like telling your kids not to do something and then they go and do it anyway. I'm guessing that would piss about anyone off. Including a DA. I don't know for sure but I would guess that a school assembly took place and everyone had a talking to. So then you keep the video and send it later. Again, you've been warned and did it anyway. You made your bed now you can sleep in it. We will see how this plays out, but I can see that happening.

Being that some are looking to find out what really happened that night a few years ago to determine whether Mo is a bad person or not doesn't really matter. What will matter is if he had the video and sent it, and was it in a way to cause emotional distress or whatever Cali's laws say. If the State proves that he is in real trouble.

One last thing. Even if they plead down to some misdemeanor, I would think it would be in the best interests of the University and the Team to do something. Even if it is some form of suspension, community service and classes. We have enough Bevo Fans out there, lets use this as a learning opportunity to aspire to be better people. "with malice toward none" and on that note, lets try and keep this conversation cool, calm and collected. Cause while for the most part things are cool, I don't want to have to get my talking stick out.:coffee:

It's kind of interesting to me as I had never heard of revenge porn until a few months ago. Saw an article while surfing and was dumbfounded that this even occurs. Guys, and probably some gals too, have hidden cameras set up in their bedrooms or just have their cell phones recording "the heat of the moment" as it were. Some post the videos as an act of revenge if the relationship goes sour and some just post it because they are jack wagons. I will never understand that mentality. Makes me very glad that I've been in a monogamous relationship for almost 40 years. I cannot ever imagine going back out into the dating game knowing all the stuff that goes on. Bad enough that there are diseases you can catch that kill you, now you have people thinking it's great sport to post videos of themselves having sex without the knowledge and consent of the other party. Sheesh!

I don't think Mo is the sharpest bulb. He needs Nebraska football more than it needs him. JMO :wave2:
Talking about the whole Mo thing with one of my brothers this afternoon. He postulated that perhaps HCSF knew more than he let on and that's why he recruited RB's as heavily as he did. Dunno, just food for thought.

Yes, it certainly seems ... persnickety...
